Who are we?

This site is maintained by S&P Netherlands Services BV, part of the Söderberg & Partners group. Söderberg & Partners is a Swedish company specializing in financial services and consulting in the areas of pensions, insurance and investment. S&P currently has more than 2,000 employees and operates in all Scandinavian countries and in the Netherlands. In the Netherlands, S&P cooperates with a growing number of partners.

This privacy statement relates to the processing of personal data of persons using questionnaire for  the determination of the risk profile.

For whom is this site intendend?

This site has two groups of users:

  • Employees and/or participants of clients of S&P/Montae & Partners for the research to determine the risk profile (also called Risk Reference Research).
  • Söderberg & Partners’ own employees.

The part of the site intended for S&P’s own employees and partners is protected and accessible only to registered and logged-in users.

 

Do we share data with others?

Determining your risk profile is done in consultation with the client. Usually this is an employer or a pension fund.
This involves collecting information about your attitude to risk, among other things. To record and analyze the information we need background information, such as your age, and of course the other answers you give to the questions.
After the session you will receive a report with an overview of your risk capacity and the choices you have made regarding your risk appetite.

We may share data with the following parties:

  • With service providers and processors we use to support and facilitate our services (including, for example, IT suppliers);
  • With third parties if required by law or required as part of an investigation, legal requirement, lawsuit, court order or legal process;
  • With third parties when you have requested this from us or you have given your express consent to do so.

 

May we process your personal data?   

We may use personal data only for a reason specified in privacy laws. Such a reason is called a basis. The possible bases are listed in Article 6 of the General Data Protection Regulation (AVG).

What is a cookie?

What personal data do we collect and use?

We process the following personal data:

    • Email address
    • Year of birth
    • Information about the household
    • Your net monthly income
    • An approximation of your monthly expenses
    • An approximation of the amount of your mortgage loans and other debts
    • An approximation of the amount of your assets (including: savings, investments, accrued and future pensions, supplementary pensions and state pension).

 

How long do we keep your data?

We do not keep your personal data for longer than is necessary for the purpose for which we process your data. But sometimes we are obliged to keep your data longer. For example, if the  Archiefwet states so or if the regulator prescribes it or if we are obliged to do so under our professional liability insurance. 

 

Profiling and automated decision-making

We use your data for profiling. Profiling means the automated collection, analysis and combination of personal data for the purpose of classifying you into certain categories and thus building a profile. To build the profiles, the profiling algorithm may include all types of relevant data listed below under point “What personal data do we collect and use?”.

We do not use automatic decision-making. After analyzing the information, you will be presented with various options and their impact on your financial situation. Decisions about which choice you make are made by you.

 

Where are personal data processed?

The data you enter will be stored on servers in the Netherlands.

   

What are your rights?

Below is an overview of the rights you have in the processing of your personal data. You can submit a written request to our Privacy Team. We will honor this request, except when doing so would prevent us from fulfilling our obligations under laws and regulations. We will respond to your request within one month at the latest. You have the following rights.

Right of access and correction
Would you like to know what information we process about you and whether it is correct? Then you can submit a request for inspection to us. Does this overview contain inaccuracies? Or would you like to have incorrect personal data removed? Then please inform our Privacy Team.

Right to oblivion
You can submit a request to have your personal data erased. You can also make a request to withdraw your consent.

Right to data portability  
Would you like to provide your personal data to another organization? You can make a request to us to receive your data in a fixed format. We will provide this file directly to you. In doing so, we are not responsible for the data processing at the organization to whom you hand over this data and/or the storage of the data in your private domain.

Right to restriction of processing personal data
You have the right in some cases to have less personal data processed. You can submit a request for this to our Privacy Team.  

Right to object
You can object to the processing of your personal data because of your specific situation. You can submit a request to this effect to our Privacy Team.

 

How do we secure your personal data?

Together with our outsourcing parties, we have made necessary and adequate technical – and organizational provisions to protect your data from loss or damage. And also to replace or restore lost or damaged personal data. Some persons working at Söderberg & Partners’ network have a duty of confidentiality due to their office, profession or legal requirement. All persons working at Söderberg & Partners sign our code of conduct which stipulates that they are obliged to maintain the confidentiality of the (personal) data they process. Except when the law requires them to disclose the data.  

 

Who supervises the processing of your personal data?

Supervision is arranged in two ways:

  1. Within Söderberg & Partners, we have appointed an independent Privacy Team to deal with all privacy issues. This team also monitors the privacy interests of those whose personal data is processed. The contact details of the Privacy Team are listed above in the privacy statement.
  2. The Personal Data Authority is the legal regulator of the processing of personal data. It monitors and has various options for taking action, including imposing a fine.

 

Do you have a complaint?

If you have a complaint about the processing of your personal data by us or about the handling of a request you have made, you can report this to our Privacy Team. After handling your complaint, do you disagree with the way your request was handled or with a decision on your request? Then you can file a complaint with the Personal Data Authority.

   

Data breach notification   

We handle your personal data with care. However, if any data accidentally ends up with the wrong person, it may be a data breach. In some situations we must report this to the Dutch Data Protection Authority. If your data is part of a data breach, we will inform you.

 

Changes

We reserve the right to make changes to the privacy statement, for example in connection with changes in laws and regulations or case law.
